License Terms for prestahost.eu Modules
These license terms ("Terms") govern your use of software products, hereinafter referred to as "Modules," purchased on prestahost.eu. By purchasing or downloading the Module, you agree to these license terms. This license applies to both paid modules and modules offered for free.
Disagreement with the License Terms
- If you disagree with the terms of this license, do not purchase or download the Module. The purchase amount will be refunded only if you have not yet downloaded the Module. If the Module has already been downloaded, you are fully bound by the terms of this license.
1. License
1.1 The Seller, who is the copyright owner (see section 2.2), hereby grants you a limited, non-exclusive, non-transferable license to use the Module for one domain, provided that you have purchased the Module legitimately.
1.2 This license does not allow you to use the Module on more than one domain without purchasing additional licenses.
1.3 You are authorized to modify the Module for your own needs, provided that such modifications are not distributed to other entities.
2. Copyright Protection
2.1 The Module and all accompanying documentation are protected by copyright according to Act No. 89/2012 Coll., the Civil Code, Act No. 121/2000 Coll., as amended (the Copyright Act), and related laws.
2.2 The owner of the copyright to the Module is the Seller, namely Václav Mach, located at Vrábče 123, identification number: 734 83 460.
2.3 You may not copy, distribute, sell, decompile, reverse engineer, or otherwise break down any part of the Module, except as explicitly stated in these Terms.
3. Restrictions
3.1 You may not provide third parties with copies of the Module or allow third parties access to the Module without the express written consent of the Seller. An exception is the provision of the Module for modifications as per section 4. In this case, you are fully responsible for ensuring that the person or company making the modifications does not distribute the Module in any way.
3.2 You may not sell, sublicense, distribute, or otherwise commercialize modified versions of the Module.
3.3 Installation of the Module for testing purposes on a PC or a web server that is not publicly accessible from the internet is allowed, provided that all other provisions of this license and the terms of trade are adhered to.
3.4 If you are an IT professional (web studio, SEO agency, programmer), you may resell a properly purchased Module to an end user and add the cost of your services to the price of the Module. You must purchase a separate license for each end user. You are responsible for ensuring that the end user complies with this license.
4. Modifications
4.1 You have the right to modify the source code of the Module for your own needs. Under no circumstances may the name of the Module, the author's name, the names of the files that make up the Module, or the license under which the Module is used be changed.
4.2 Modification of the source code does not transfer copyright to you or any third party that made the modifications. The copyright owner remains the Seller.
5. Liability
5.1 The Seller is not liable for any damages arising from the use or inability to use the Module, regardless of whether such damages were caused by an error in the Module, human error, or otherwise.
5.2 The Seller's liability for any defects in the Module or for direct or indirect damages is limited to the amount you paid for the Module.
6. Penalties
6.1 In the event of a breach of these license terms, you are obliged to pay a contractual penalty of CZK 30,000 for each breached obligation.
6.2 Payment of the contractual penalty does not affect the Seller's right to full compensation for damages.
7. Unauthorized Acquisition of the Module
7.1 The use of the Module is only permitted for users who have obtained it legally. If you have acquired the Module illegally (e.g., via piracy), you are violating copyright law and must immediately cease using the Module and remove it from all your devices.
7.2 The Seller reserves the right to take legal action against those who acquire or use the Module illegally, including but not limited to seeking compensation for damages and lost profits.
8. Final Provisions
8.1 These Terms are governed by and construed in accordance with the laws of the Czech Republic.
8.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
By continuing to install or use the Module, you agree to the above terms.
